FAMILY AND PARTNER VISAS

Child visas (ONSHORE & OFFSHORE)

This is a permanent resident visa for dependent children of Australian citizens, Australian permanent residents or eligible New Zealand citizens.

Who is this visa for?

To qualify for this visa, you must:

  • Be sponsored by an eligible person
  • Be single
  • Be under 18 years of age or
  • between 18 and 25 years of age and a full-time student or
  • Be 18 years or older and be fully dependent on the sponsoring parent
  • Meet health and character requirements

Sponsor

To be eligible for this visa, the parent should be:

  • An Australian Citizen or
  • Australian Permanent Resident or
  • Eligible New Zealand Citizen

A child visa application can be made outside or in Australia.

Only children under 25 years of age can apply for this visa unless they have a disability that stops them from working.

If the child is 18 years of age or over, they must be a full-time student and financially dependent on the sponsoring parent.

As a full-time student, the child must be enrolled and actively participating in a course that leads to a professional, trade or vocational qualification and have commenced that course since turning 18 years of age or within six months or a reasonable time after finishing school.

Furthermore, the child must not be married, engaged to be married or in a de-facto partner relationship.

Am I eligible for this visa?

Parent visas (ONSHORE & OFFSHORE)

These visas are for parents who wish to migrate to Australia to live with their children.

Who is this visa for?

To qualify for this visa, you must:

  • Be sponsored by your child who is settled in Australia
  • Pass the ​Balance-of-family test
  • Meet health and character requirements
AO Parent visa

Balance-of-family test

To be eligible to apply for the Parent visas, you must pass the Balance-of-family test:

  • at least half of your children live permanently in Australia or
  • more of your children live permanently in Australia than in any other country

Sponsor

To be eligible for this visa, the parent should be:

  • An Australian Citizen or
  • Australian Permanent Resident or
  • Eligible New Zealand Citizen

The sponsor must be settled in Australia. To be considered settled, the sponsor must have been residing in Australia for at least 2 years prior to lodgement of the Parent visa application.

Since the contributory parent visas attract higher visa application charges, you have 2 options.

You can either apply directly for permanent resident visa or choose to go through a 2-stage application process and first apply for a temporary visa.

The 2-stage process allows you to spread the costs of the visa.

Am I eligible for this visa?

Partner visas (ONSHORE & OFFSHORE)

In case you are in a de-facto relationship or married or plan to marry an Australian citizen, Australian permanent resident or eligible New Zealand citizen, you can apply for a partner visa.

Who is this visa for?

To qualify for this visa, you must:

  • Be at least 18 years old
  • Meet the health and character requirements
  • Be sponsored by an eligible person
  • Demonstrate that you have a genuine and continuing relationship with your partner

Relationship types:

 

 1. De-jure Relationship (legally married)

You can be legally married either in Australia or overseas. In case you  married your partner overseas, your marriage must be valid under Australian law.

 2. De-facto Relationship

You and your partner, who may be of the same or opposite sex, must as a couple be living together on a genuine domestic basis. You must be able to demonstrate that you have been in a de facto relationship for at least 12 months.

In case you register your relationship in the state or territory where you live, you might be able to apply for the partner visa even if you have lived together for less than 12 months.

Relationship Requirements:

You will need to provide as much evidence as possible to support your claims regarding the following:

  • financial aspect of your relationship
  • the nature  of  your  household
  • social context of  your relationship
  • the nature of your commitment to each other

To be eligible for this visa, the parent should be:

  • An Australian Citizen or
  • Australian Permanent Resident or
  • Eligible New Zealand Citizen

Stages

The partner visa application can be made outside or in Australia.

The partner visa application is a 2-stage process. First you must apply for a partner temporary visa. Once you have been granted a temporary partner visa, you will be able to work or study full-time in Australia.

The temporary partner visa is valid for 2 years. 2 years from the lodgement of the temporary partner visa, you can be eligible to apply for the permanent partner visa.

Prospective Marriage Visa

A Prospective Marriage visa is a temporary visa valid for 9 months. You must be outside Australia to apply for this visa.

Once the visa is granted you must marry your fiancé(e) within the validity period of the prospective marriage visa. Then you can apply for the Partner visa in Australia.
